Court Invalidates Edo State PDP Primary

The Federal High Court sitting in Abuja has nullified the Edo State Peoples Democratic Party (PDP)’s primary election of February 22nd.

Justice Inyang Ekwo announced the decision of the court on Thursday.

The court ruled that the PDP’s primary election that led to the selection of Asue Ighodalo as the party’s candidate for the upcoming governorship election in Edo state did not follow the requirements set out in the Electoral Act of 2022, the guidelines for the poll, and the party’s constitution.

In his reuling, Justice Ekwo said that the Exhibit PDP 1, presented by the party, lacked supporting evidence, therefore, ruled that the plaintiffs successfully proved their case against the defendants by submitting relevant exhibits.

Ekwo held that from the exhibit tendered in court, the returning officers who prepared the result sheets only sat in one place to falsify the outcome of the poll.

He said the exclusion of the 381 delegates, including the plaintiffs, was against the provisions of the law.

The judge further held that even though the Independent National Electoral Commission (INEC) filed a memorandum of appearance in the suit, the commission did not file any process in the case.
