The Nigerian Bar Association (NBA) has condemned reports that a judge of the Federal High Court in Abuja allegedly ordered a lawyer to kneel during proceedings, describing the action as a threat to the dignity of the legal profession.
NBA President, Afam Osigwe made this known on Tuesday in a statement he signed and shared on the association’s X handle.
TheFactDaily gathered that the incident happened on Monday, March 16, 2026, involving Justice Mohammed Umar and defence counsel, Mr. Marshall Abubakar, who appeared for activist Omoyele Sowore.
Judge Umar directed the lawyer to kneel after he raised his voice while addressing the court over a hearing date and also threatened committal for contempt.
Reacting Osigwe said ,the association viewed the development “with utmost seriousness” given its implications for courtroom standards and professional conduct.
“No judge has the power to order a lawyer to kneel in court. Such a directive is not a recognised judicial sanction under our laws and does not align with the standards of judicial conduct expected on the Bench,” Osigwe said.
He stressed that while judges are empowered to maintain order in their courts, such powers are not absolute and must be exercised within clearly defined legal boundaries.
“The power to punish for contempt is well recognised; however, it is circumscribed by defined legal procedures designed to ensure fairness, objectivity, and respect for the rights and dignity of all persons appearing before the court,” he added.
The NBA further noted that the dignity of the court must be preserved not only in its decisions but also in the manner judicial authority is exercised.
“The courtroom is a temple of justice, governed by law, procedure, and decorum. If a judge is of the view that a person has acted in a manner that is contemptuous, the judge must follow the accepted legal process for such proceedings,” the statement read.
While criticising the reported action, the association also cautioned lawyers against misconduct in court, urging adherence to professional ethics.
“Legal practitioners are obligated to advocate firmly and fearlessly, but always within the bounds of courtesy and decorum. Disagreements with the court must be expressed through proper legal channels,” Osigwe stated.
The NBA called for calm among stakeholders and urged that grievances arising from courtroom incidents be addressed through appropriate institutional and disciplinary mechanisms.
It added that it would engage relevant authorities where necessary to ensure that the rule of law, judicial ethics, and professional standards are upheld.
