The Supreme Court has struck out an appeal by the People’s Democratic Party (PDP) calling for the restoration of the null and void participation of former Osun State Governor Gboyega Oyetola and Deputy Benedict Alabi in the July 16, 2022 gubernatorial election.
Delivering the judgement on Thursday february 2, 2023 a five-man panel of the Supreme Court, led by Justice Chima Nweze, found the PDP appeal to be without substantiation and had directed the party attorneys to withdraw the suit.
TheFact Daily reports that Justice Emeka Nwite of the Federal High Court of Abuja, in a ruling on September 30, 2022 nullified Oyetola and Alabi’s participation in the gubernatorial election on the grounds that their nomination forms was confirmed by an Acting Chairman of the APC who is also a serving governor of Yobe State, Mai Mala Buni.
But the Abuja division of the appeal court overruled Justice Nwite’s ruling in December last year, a decision the PDP appealed to the Supreme Court.
In the ruling, the Supreme Court held that the PDP could not by law question the process that led to Oyetola and Alabi as All Progressives Congress (APC) candidates in the election.
