The Economic and Financial Crimes Commission (EFCC), has filed a notice of appeal against a Federal Capital Territory (FCT), High Court judgment that found it liable for defaming former Minister of Power, Olu Agunloye, over a social media publication of an alleged $6billion Mambilla Power Project fraud.
EFCC’s Head of Media & Publicity, Dele Oyewale, in a statement on Sunday disclosed that the Notice of Appeal, filed at the Court of Appeal, Abuja on Friday, July 10, 2026, was submitted by the Commission’s counsel, Wahab Shittu, SAN.
The appeal, filed under Suit No: FCT/HC/CV/1199/2024, challenges the entirety of the judgment delivered by Hon. Justice Peter O. Kekemeke of the FCT High Court, Maitama, Abuja, on July 8, 2026.
According to the notice, the EFCC expressed dissatisfaction with “the whole of the judgment.”
Justice Kekemeke had ruled that the EFCC’s publication on Agunloye was false, defamatory and injurious to the former Minister’s reputation and awarded N10 million in damages against the Commission.
In its appeal, anchored on 11 grounds, EFCC is seeking four key reliefs: that the appeal be allowed, that the entire judgment be set aside, that Agunloye’s claim before the trial court be dismissed in its entirety, and any other order the court may deem fit.
Shittu also filed an application for a stay of execution of the trial court’s judgment pending the outcome of the appeal.
No date has yet been fixed for the hearing of the appeal.
